Standard Terms & Conditions for Placement Service

“KNHS INC.” will search and screen candidates on behalf of “CLIENT” to provide such duties as may be specified on Family Application Questionnaire or as may be otherwise agreed between “CLIENT” and the employee at the time of placement.

Screening
“KNHS INC.” agrees to provide said screening services as “KNHS INC.” deems suitable with the results made available to client.  Screening shall include, but not be limited to the following,

• Application Form
• Drivers License Check
• Police and Criminal Background Check
• Personal Interview
• Reference Verification

Candidate Suitability
The “CLIENT” will interview the employee applicant and will make the final decision as to the particular employee to be placed with the “CLIENT”. That decision will be based solely upon the “CLIENT’S” assessment of suitability and not any recommendation given by “KNHS INC.”  The “CLIENT” agrees that the employer / employee relationship shall exist between the “CLIENT” and employee/s, and not between the employee and the agency.

Service Fees
The fee to begin placement service is a non-refundable registration/search fee. The balance of the placement fee is due upon hiring the employee, this payment must be received prior to employee reporting for work at "CLIENT'S" home. The employee will not be placed with the “CLIENT” if payment is not completed. All deposits, placement fees and extended replacement policy fees are non-refundable.

Replacement Policy
“KNHS INC.” provides a replacement policy which begins the date the employee begins work in the “CLIENT’S” home.  If, while the replacement policy is in effect the employee leaves or is fired for any legitimate reason by the “CLIENT”, “KNHS INC.” will search for and screen a replacement employee for the “CLIENT”. There will be no extensions granted on a replacement policy expiration date. "CLIENT" is required to purchase a new placement contract if the replacement policy period expires. "CLIENT" may purchase an Extended Replacement Policy only if the existing replacement policy is in effect. The Extended Replacement Policy will become active the first day after the existing replacement policy expires. "CLIENT" may purchase unlimited Extended Replacement Policies.

Policy Termination
"KNHS" reserves the right to terminate a Placement Contract and Replacement Policy if the "CLIENT" is found to be verbally, sexually and/or physically abusive to Kensington staff, the placed employee or the CLIENT'S spouse or children.  

Employee Supervision
The “CLIENT” is solely responsible for the supervision of their employee. “KNHS INC.”  is not responsible for acts or failure to act by the employee.  “CLIENT” agrees to indemnify and hold harmless “KNHS INC.” from any and all claims resulting from any and all acts or failure to act of the employee.

“KNHS INC.” specifically disclaims any warranties not expressly contained within this
agreement.  The guarantees provided herein shall be the sole and exclusive guarantees between the parties.

In the event “KNHS INC.” retains an attorney/s to enforce the terms and conditions of this contract, or to collect any outstanding fee owed under this contract, “CLIENT” agrees to pay “KNHS INC.” reasonable attorney’s fees and costs.

The terms & conditions outlined herein are governed by and construedto be in accordance with the laws of the State of Florida.  This is the entire Agreement  between  “KNHS INC.” and the “CLIENT”.  It may not be changed orally but only by an agreement in writing.  This agreement revokes any and all prior Agreement of the parties.
